Payment Dispute Legal Rights

Summary

In California, both parties in a legal dispute have the right to know and cross-examine witnesses. If a witness, like the housekeeper in your case, was not disclosed beforehand, it can affect their credibility and the fairness of the hearing. You have the right to file a complaint with the court regarding undisclosed witnesses. Evidence such as photos and timestamps are crucial in proving your case. If you have a harassment suit in the works, consider seeking legal advice to understand the implications of the housekeepers testimony and how it might affect your case.

I had a stipulation agreement to make a payment by Jan 31st. I dropped the payment off in the 31st, with the date clearly timestamped for Jan 31st. My landlord filed ex parte against me claiming non-compliance to the Jan 31st due date. In the court doc the Mgr claimed the payment was tendered Sunday Feb *. At the hearing on Wed Feb 5th, the mgr stated that it was actually the housekeeper that saw my envelope on Sunday. And that it wasn't there when she got there, but it was there later, implying I actively/physically dropped it off during the timeframe the housekeeping alleged on Sunday.
It sounds like you have a dispute over the timing of your payment. A few key things to consider might be:
- Evidence showing the payment was made on January 31st.
- Testimonies or any witnesses who can confirm your actions.
- Any communication with your landlord or property manager regarding the payment.

Part *: Well we know that's all a lie because I had photo proof that I dropped the laundry off at *:* Jan *. If they ignored the Jan 31st timestamp on my money order, and are solely basing my alleged non-compliance on the word of this housekeeper, shouldn't her testimony been mentioned if not in Lori's written statement, but then her own submitted declarations? There was no mention of this housekeeper until the Mgr brought it up in court.
It sounds like you have a strong case if you have proof of payment and a timestamp. Typically, for such disputes:
- Evidence like photos and timestamps are crucial.
- Witness testimonies are important, but they should be disclosed before the hearing.
- Any undisclosed witness testimony may be challenged in court.

I won & they looked like fools. But I wanna know if I have a right to demand or if they were supposed to have a statement from this housekeeper. & What it means that they didn't. Not to mention it was a total lie since the payment was made on the 31st, which I proved. So that means either the housekeeper lied on me & to her boss. Or the mgr made up the story about the housekeeper. It doesn't make sense that the Mgr would even have a convo with the housekeeper about when * if * envelopes was on the floor
