Security Deposit Return Issues

Summary

In New Jersey, landlords must return security deposits within 30 days after a tenant moves out. If the landlord breaches the lease, tenants may have the right to break it. Landlords can charge rent until the lease ends or the unit is re-rented, but this should be specified in the lease. Consulting a lawyer can provide tailored advice for complex lease issues.

Hello ****, according to New Jersey law:
- Your landlord should return the security deposit within 30 days after you move out.
- If any deductions were made, a detailed list should be provided.
If they fail to comply, you can sue in Small Claims Court.
Yes. But, i moved out 3 months after i moved in, not completing the lease because they broke the lease by not providing me with peaceful enjoyment of the premises which is a tenant right.
Hello ****, in New Jersey, if the landlord breaches the lease, you may have a legal right to break it too. To pursue this, you might:
- Document the issue.
- Notify the landlord and give them a chance to rectify.
- Consider filing a suit in Small Claims Court if unresolved.
In addition when i stated i was leaving, not the landlord nor the leasing agent spokeanything about my having to continue paying rent until the apartment is rented. And, i do not see that on the leaee either
Hello ****, in New Jersey:
- A landlord can charge rent until the end of the lease or until the unit is re-rented, whichever comes first.
- This should be specified in the lease. If it's not, they may have a harder time enforcing this.
You could consider legal advice for your specific situation.
Thank you. Should i go with a lawyer?
