I live in Hendricks County * and I'm looking at being evicted tomorrow but i have applied for emergency rental assistance in oct of * which was approved in February of * they paid all back rent the IERA portal keeps record..ERA * IS recertification basically a second round of emergency rental assistance which my landlord was aware of will a couple days after that I had told him that i was waiting for ERA * to let me know my next step I keep in touch with him let him know what is going on as soon as I know what is going on well on May 14th of * he sent me a letter stating that I was behind which I already knew that I had to pay a third of the amount on or before Saturday May 18th or vacate the apartment by *:* p.m. on May 18th It also says if you pay the above amount $* you can stay that must pay * every Saturday until you are caught up with the rent when it's caught up you will then pay $* for a week for rental agreement to continue to live in the unit now prior to this he know that I had already sent in my staff for my emergency rental assistance I guess what I'm asking is is it legal for him to evict me knowing that I'm already waiting on you know them to let me know my next step and he I've already been through the first one so it's not a court paper or anything it's just written out by the landlord himself so doesn't have a court date or anything on it but I wanted to do this legally like I would like to wait until you know they get all this approved and done and then if you know I still can't seem to keep up my rent then I have no problem leaving but I see no use in leaving until I find out what's going on with them because they will pay right up to the day that they send it out if it's two three months from now they will pay every single bit of that so I just didn't see the significance of the eviction if he knew he was going to get paid but I wore too that he could also hold the money and still get me for non-payment rent not saying that he would do so but this is why I wanted to stay put right here in my apartment until everything was said and done and everything was caught up and anything past that would be on me
Hello Michelle,
In Indiana:
- Landlords must provide you with a written notice before they can initiate eviction proceedings.
- If you've received assistance from ERA, this might influence the eviction process.
- Landlords can't evict tenants in retaliation for exercising legal rights.
Please consult a local attorney for advice tailored to your situation.
