I live in Louisville Kentucky I recently under went colon cancer operation. My landlord informed Cancer Society that I owe $* for back rent. They said I owe for a new lease agreement that was emailed to me last June. I explained I have email but usually don't use it. I'm being evicted because they say I never renewed lease. Have been paying same rent since I moved here. The have paperwork showing missed payments which is untrue. My bank statements show never missing rent. I lived here for 2 years using space heaters because furnace didn't work. Now the have me in evicting court about owing them back rent. They say just because I don't use email is my fault. I feel I should have gotten physical lease in mail or phone call. My mom has email for me and now new lease and their account has showed up. Is this legal. I feel if cancer Society wasn't going to pay my rent is the reason for this. People in their office have all but cussed me out about this
Hello Anthony, I'm sorry to hear about your situation. Here are some general points on Kentucky law:
- Landlords are required to provide a habitable dwelling, failure to repair furnace could be a violation.
- Eviction due to non-renewal of lease requires proper notice.
- Your bank statements may serve as proof of payment.
I'd recommend consulting with a local attorney for personalized advice.
Ok, thanks. I feel if it wasn't for rent to be paid by cancer Society they would have just kept excepting my rent.
