I rent an apartment in Manning, Iowa with my 13 year old son. I do not have a signed lease. I'm always behind or late on rent. My landlord and I are pretty informal and always work something out. The beginning of July I go home to discover my apartment door is locked. We had an agreement (text message evidence) to always keep my door unlocked cuz I didn't have a key. This isnt the first time my landlord has done this. He locked me out because I owe backrent for April, May, and June, with the understanding I would pay it with my tax return which I got a 6 month extension for and have yet to file. So, beginning of July my apartment is locked, I do what I always do in this situation, I don't engage or confront my landlord and I figure in a few days he will unlock it. July *, a mutual friend informs me that the previous day he was in my apartment with the landlord to check on sewage that had backed up into my bathroom. I told my friend I knew nothing about it because i had been locked out of my apartment for the entire month. My friend was unaware of the lockout. On July *, I get a picture text from my landlord of the raw sewage that had backed up into my entire bathroom with the caption "thanks Britt". I responded by asking him how did he suppose I had anything to do with the sewage back up and he responded by telling me that it was my fault it backed up because I hadn't been there to run water through the pipes for an entire month. Again I had the same reply of how does he suppose that's my fault. Aug * he text me and asked for rent or he was gonna start selling my assets til he was paid off. From the apartment. On Aug * he text and told me he had sold the golf clubs and that it didn't matter when or for how much cuz I still owed him money and said he had the apartment "abandoned" I asked him what he meant by "abandoned" the apartment and I got no reply. On Aug * I again asked him what he meant by 'abandoned' the apartment and got no reply. On Aug * I observed the upstairs tenant and my landlords girlfriend going in and out of my apartment. So I called the police to report the lockout and the people trespassing. The police informed me it was a civil matter. I called the county court house to determine if my landlord had ever tried to have an eviction notice served to me. I was informed by the courthouse that my landlord had never filed anything. Later that day on Aug * I observed the lock to my apartment being changed. I sent a text to one of the people I saw at my apartment and I formed them that I was illegally locked out and that they were all trespassing. I informed them that my dad's ashes were in the apartment. They responded by telling me to grow up. On Aug * I text my landlord and asked if I was gonna be allowed access to my stuff and he replied by asking me for rent for the previous 5 months. I told him I didn't agree because I had been locked out for * of those months. I told him I would only pay him for April, May, and June because I had lived in my car for the past few months. My landlord denies locking the apartment at the beginning of July. He claims to have locked it on Aug * because people had been getting into it and he hadn't heard from me in 3 months. I have proof that he's lying. I have witnesses, my sister, my son, my ex, and several friends, who frequently went to my apartment to check to see if it was still locked over the course of the summer. And it always was. My landlord text and said Aug 10th was also when he discovered the backed up sewage and boarded up the inside door and changed the apartment lock. I have proof that he is lying. I have text and messages from him dated July * with a picture of the sewage back up. July *, not Aug 10th like he is now trying to make it seem. He claims that if it weren't for him going in on Aug * and securing the place, that I would have nothing left of personal property because he claims that * men were seen coming and going from the apartment all summer long. He claims to have thought I was also a part of the coming and going all summer, until, he claims he was informed by witnesses that I was not with the * men seen taking my tv late one night informed by witnesses that
