Summary
Filing an appeal in Kentucky can temporarily pause the enforcement of a court judgment. However, the right to collect rent during the appeal process can be complex and depends on the courts decision. Since the judgment did not address rent, it may still be possible to collect it unless the court rules otherwise. Consulting with a local attorney who specializes in Kentucky property law is recommended to clarify your specific rights and options.Full Conversation
I have a recorded deed for contract house i bought under false pretenses. Despite the fact that i have solid proof of everything, the seller, who is also a fill in judge for the same court, won a judgement for the house to be turned iver to the commissioner and 90 days to sell. I did appeal. I have renters in there. So what does the appeal do? Am i entitled to the rent money still
Hey ****! In Indiana, filing an appeal can temporarily halt the enforcement of the trial court’s judgment, depending on the specifics. As for rent, generally, the property owner during the appeal may still collect rent, but this can be complex. Consulting with a local attorney is advised.
