I won a land case in the lower court with judgement to take possession of my property. The defendants in the case were the seller of the property and the buyer/trespasser. They both appealed to the court of appeal and yesteday the court dismissed the appeal of the buyer/ trespasser on the land. The court adjourned the seller of the propery's case until october. Can I enforce judgement and take possession of my property since the trespasser's case has been dismissed
Hey Tony! In New York, whether you can enforce the judgment and take possession of the property may depend on several factors, including the specifics of the judgments and the appeals. Here's some general information:
- If the court dismissed the trespasser's appeal, you may enforce the judgment against them.
- However, the seller's appeal is still pending. If their appeal affects your right to possession, you might need to wait until it's resolved.
It's advisable to consult with a local attorney to review your court documents and provide guidance specific to your case. Do you want help connecting with a local lawyer?
