In Ohio, the adverse possession law requires a *-year period of hostile possession. Are you the possessor or the property owner?
Yes. I’ve researched guite a bit. I have a question
Of course, Ilona. What's your question regarding adverse possession in Ohio?
a fence has been there *+ years. New neighbors moved in * yrs ago? She has taken the old fence down, put up a new one. Took that fence down put up a new one. Before she moved in the house was vacant for awhile. Yard wasn’t maintained. City hired people to mow it. Since it was vacant, does that break the chain of continuse? Tacking ?
Did the new neighbor acknowledge your ownership of the land where the fence is located when they moved in?
In Ohio, for adverse possession:
- Possession must be hostile
- Possession must be continuous for 21 years
- Possession must be exclusive and open.
In Ohio, for adverse possession:

we never really spoke. She just asked me to watch workers. Make sure they were working. She’s a horrible horrible thing. I can’t bring myself to say human for her and family
Did the new neighbor ever explicitly recognize your ownership of the land where the fence is located, either verbally or in writing?
no
In Ohio, adverse possession requires continuous, open, exclusive, and hostile possession for 21 years. If the neighbor didn't acknowledge your ownership, it might not break the chain.
but it was vacant, foreclosed on, did bankruptcy route
Did the period of vacancy and foreclosure interrupt your continuous possession of the property for 21 years?
i don’t know what you mean . I was mowing the side yard where there was no fence. She’s * ft on my land
Did you continue to mow and maintain the side yard during the period of vacancy and foreclosure?
yes. Not the back because of the fence
Did the fence prevent you from accessing and maintaining the entire property during the period of vacancy and foreclosure?
yes. The back
Did you ever attempt to remove the fence or communicate with the neighbor about its placement during the period of vacancy and foreclosure?
no. They were gone all of a sudden
Did you ever file a formal complaint or take any legal action regarding the fence encroachment during the period of vacancy and foreclosure?
no. I never had a house before.
Did you ever receive any formal notice or communication from the city or the bank about the foreclosure and vacancy?
I got a call from someone looking for someone, but I didn’t know their names
Did the call you received have anything to do with the property or the fence issue?

no
Did you have any written agreement with the city or any other party about maintaining the land during the period of vacancy and foreclosure?
no
In Ohio, the period of vacancy and foreclosure does not necessarily break the chain of continuous possession for adverse possession if you maintained the land.
what does not necessarily? What would?
"Not necessarily" means it's not a guaranteed outcome. Factors that could break the chain include explicit acknowledgement of the true owner's rights or a break in the continuity of possession.
