Land Use Legalities Explored

Summary

In the UK, agreements for land use over three years generally require a formal lease by deed and registration. Without this, CLD may lack the legal authority to issue licenses, potentially rendering them void. The solicitors actions in court could be questionable if they withheld information about CLDs legal standing and your mothers condition. Consider consulting a solicitor to address these issues and explore the possibility of voiding the license agreements.

There is only an informal agreement between Boswell and CLD, in fact I think its just a verbal agreement if that.
Given the informal or possibly verbal agreement between Mr. Boswell and CLD, there are key issues to consider:
- Licence vs Lease: CLD requires a formal lease to legally issue licences and confer rights to lodge owners.
- Legal Authority: Without a lease, CLD's ability to collect fees and terminate licences may be legally unsound.
Would you like guidance on addressing these issues legally?
Yes Please. Also the company CLD took my mother to court and then terminated her licence. She had dementia and was unrepresented. The solicitor representing CLD knew the comany only had an informal agreement with Boswell meaning the company had no legal right to issue licences, collect rents or terminate these 20 year agreements. The solicitoy also knew my mother had demencia as she was given a doctors notes in which it clearly says my mother has demencia. Has the solicitor acted correctly or is it possible she has frauded the court by not telling the court the CLD had no legal rights to have ever issued licences and my mother should be a proteced person with a litigation friend. Also should the licence agreements be void as they were arranged and signed by CLD
The solicitor may have breached their duty to the court if they knowingly withheld information about CLD's lack of legal authority and your mother's dementia. Potential issues include:
- Misleading the Court: Failing to disclose material facts, like CLD's informal agreement and your mother's condition, could mislead the court.
- Litigation Friend: Your mother may have needed a litigation friend if she was unable to represent herself due to dementia.
The license agreements could be void if CLD lacked the legal authority to issue them. Consider consulting a solicitor for further action.
did CLD have a legal right to issue licences or should it have arranged a lease under deed with Boswell as this informal arrangment was not legal and had been going on for 12 years

CLD should have arranged a formal lease with Mr. Boswell, as a license does not confer legal interest in land. Without a lease, CLD lacked the legal right to issue licenses. Would you like to be connected to local lawyers who can better assist you with your case?
CLD continues to offer licences and collect rents. Is it acting illegally?

CLD's actions may be illegal if they continue to offer licenses and collect rents without a formal lease agreement with Mr. Boswell. The lack of legal authority to issue licenses could render these agreements void. Would you like to be connected to local lawyers who can better assist you with your case?
this is under UK law which I think says that any agreement to use land longer then 3 years must be under a lease by deed and registered. Id=s that correct?

In the UK, agreements granting rights to use land for more than three years typically require a formal lease by deed and should be registered. Without such a lease, the ability to issue licenses could be legally challenged. Would you like to be connected to local lawyers who can better assist you with your case?
so you don't know as you keep saying could and may and possibly. Why not go find out
