Hi Bob! How can I assist you with your legal issue today?
I am a co-owner of the driveway with my neighbor. The driveway is shared usage for both of us. Recently, my neighbor placed pots and other installations unilaterally, without taking permission. Now, he is using that to usurp the shared property, making useless claims that the driveway belongs to him exclusively. I notified him to remove the pots immediately. Have given several notices. All peaceful resolutions have failed since he is not even willing to talk. Mediation, and third-party intervention has also failed. Peaceful protest, and strategies of causing minor inconvenience to the neighbor to redress the violation has also failed. In order to defend my property and prevent it from being usurped, as a last resort, I had to break his pots since that was the only option left. In these circumstances am I justified in my action to break the pots in order to protect my rights?
It's a tough situation, Bob. While you may feel justified, breaking your neighbor's possessions could lead to legal consequences. In Sindh, property disputes are typically handled under the Sindh Land Revenue Act. It may be better to file a formal complaint or seek a court order to resolve the issue legally.
Have you considered consulting a lawyer to explore your legal options?
Law does not word here since the legal system in non-existent. It is either I break his illegal pots or I accept his violations. I had to do this as an act of self-defense. Am I wrong in thinking like that?
Bob, I understand your frustration. However, taking matters into your own hands by breaking his pots can lead to legal consequences. Here are some points to consider under the Sindh Land Revenue Act:
- Property disputes should be resolved legally through proper channels.
- Filing a formal complaint or seeking a court order might be a more effective way to protect your rights.
