Condo Board Accommodation Denial

Summary

If a condo board in Ohio doesnt fully uphold a reasonable accommodation, it may be considered a denial under the Fair Housing Act. Partial accommodation might still violate the law. Document instances of non-compliance and consider filing a complaint with HUD or the Ohio Civil Rights Commission. Legal consultation can provide further guidance.

request was to stop ALL unnecessary outdoor noise. board is now trying to make their own intepretations as to my meaning in my request (but my meaning is clear...ALL). board says my further complaints about ongoing noise do not warrant a response from them.
It sounds frustrating that the board is not addressing your concerns fully. To help you further, could you provide more details on the nature of the outdoor noise you're experiencing and any specific responses or actions the board has taken so far?
noise is generated right below my bedroom window, my bedroom is my comfort zone, my place where i ameliorate my pain and fatigue...nexus was given for my request. neighbors tend to like to gather below my window and allow children to play there in the area. this are is, per our condo declaration, NOT an area designated for these activities...it's for parking vehicles and accessing entry/exit of attached garages and units. they're out there during warm weather months sometimes */* times a day, sometimes for hours at a time...tailgate parties, grilling, etc.
It sounds like your condo board may be failing to enforce the rules as outlined in your condo declaration, which is affecting your quality of life. Here are a few steps you can consider:
- Review your condo declaration to confirm the designated uses for the area.
- Document instances of noise with dates and times.
- Write a formal complaint to the condo board, referencing specific rules and your documentation.
- Consider mediation or legal action if the board does not respond adequately.
Would you like information on how to escalate this issue legally in Ohio?
i've tried all appropriate notices of violations...the board looks the other way. former condo board president is one of the participants.

It seems like you've already taken significant steps to address this issue. Since the board is not responding to your formal complaints and a former board president is involved, you might consider taking stronger legal action.
Here are some options:
- Consult a lawyer: This could help you understand your rights and the best course of action.
- File a complaint: With the Ohio Civil Rights Commission or HUD if you believe it's a Fair Housing violation.
- Consider a lawsuit: For breach of your condo declaration or discrimination if applicable.
Would you like assistance with finding legal resources or further guidance on how to proceed?
can't afford a lawyer, but am going to go to hud i think

It sounds like you have a strong basis for a complaint with HUD given the potential violation of your rights under the Fair Housing Act. Here is what you can do:
- File a complaint with HUD: You can do this online at HUD's website.
- Ohio Civil Rights Commission: You might also consider filing a complaint with them.
Would you like assistance with any specific part of the HUD complaint process?
how do i explain to hud that i feel like the condo board is only partially upholding my reasonable accommodation?
Case Rating: *
You can explain your situation to HUD by following these steps:
- Clearly describe your disability and how the noise affects your health.
- Mention the specific reasonable accommodation you requested.
- Detail how the condo board is only partially upholding your request.
- Provide documented instances of noise and the board’s insufficient responses.
Would you like a template or more specific guidance on any of these points?
no thanks. not at this time. for right now, i'm in planning stage. i have given the board until end of month to explain why they don't feel i warrant a response and why rules don't matter.

It seems like you're taking the right steps by planning and giving the board time to respond. If they fail to respond satisfactorily, you can file a complaint with HUD as discussed. Make sure to document everything meticulously. If you need more guidance in the future, feel free to reach out.
