Wrongful Eviction Legal Guidance
Summary
In Maryland, tenants cannot be displaced due to property condemnation without being offered a suitable replacement with comparable rent. If an eviction notice is issued without proper inspection or adherence to local codes, it may be considered wrongful. Tenants have the right to challenge such evictions. If you believe your eviction was improper, consult with a local attorney to explore your options. Legal aid services in Carroll County, MD, can provide specific guidance and support.Full Conversation
We were living in an old farm house owned by a church for the last 8 years but this April we got an eviction letter that appeared to be in the form of a printed out email. They said the house had structural damage to the roof and foundation and they were condemning the house and kicking us out. The inspector didn't set foot in the house so his assessment wasn't accurate.
I'm now at a homeless shelter where I have been since August. People here including the staff treat me very poorly.
The reason I think there might be a wrongful eviction case is that I have looked up the codes of Carroll County MD where we live and it says a landlord can't displace a tenant due to a house being condemned without finding a suitable replacement appartment with comparable rent within a reasonable distance. They didn't do that.
I'm sorry to hear about your situation. Since you're dealing with an eviction in Maryland, I recommend contacting local legal aid services as they can provide more specific guidance and support. Would you like me to connect you with local lawyers who can better assist with your case?
One thing I have to say is that I am autistic and also have OCD and that house was my entire world even though it was rented. I lived there for the last eight years and had a garden which died due to lack of water.
Since being in the shelter it's been one bad thing after another. One thing is that because I am now outside * hours a day I was not used to it at first and got a sunburn that was so bad that my entire forehead got swollen. I also got an eye infection where I couldn't open my right eyelid. I had the flu five times in the last 6 months, a super bad sore throat four times at least, and a bad cough that lasted a month long. I also lost half of my hearing in my right ear for a month.
It sounds like you're going through a very challenging time. I'm here to help you. Since you're dealing with a potentially wrongful eviction, I can provide some general information on tenant rights in Michigan. Here are a few points:
- In Michigan, landlords must follow strict legal procedures to evict a tenant, including providing proper notice.
- If the eviction is due to the property being condemned, landlords may need to ensure that the property is actually condemned by a proper inspection.
- Tenants may have rights to challenge an eviction if they believe it was done improperly.
Would you like me to connect you with local lawyers who can better assist with your case? If so, I will need your phone number, name, and zipcode.
