Eviction And Rent Collection
Summary
In Nevada, landlords are prohibited from collecting rent after an eviction unless specified by a court order. Tenants must receive proper notice and have the right to contest evictions in court. If a landlord charges for legal notices that were never received, it may be a violation of tenant rights. Relevant statutes include NRS 118A.480, NRS 118A.490, and NRS 40.253. Consider consulting a local attorney for personalized advice and to address potential legal violations.Full Conversation
I live in Nevada, a mobile home and was evicted from the lot I rented. The lot was not in the park and they let the landlord use the summary eviction process. They were granted the eviction and a writ of restitution was issued. The rental payment was current, no back rent owed and because our home was there still, we continued to pay rent. The court did not order us to, we were locked out of the house and not allowed back in. Did the landlord break the law by taking our rent money after being evicted when we didn't owe anything?
It sounds like a complex situation. To better understand, could you provide more details about the eviction process? Specifically, did you receive proper notice and were you given a chance to contest the eviction in court?
We were given notice and we had a chance to go to court but the judge would not listen to the evidence. She said that she wasn't allowed to look at it and that she was only there to determine whether or not we could keep possession of the house.. we had evidence that showed you change the ledgers several times to add up to a bill that is not valid and since then she is charged $*,* for legal notices that we never received
