Lease Termination Obligations Clarified

Summary

In Massachusetts, once your apartment is re-rented and a new tenant signs the lease, you are typically not liable for rent beyond that point. However, you may still be responsible for rent up to the re-renting date, administrative fees, and any costs incurred by the landlord due to early termination. It is advisable to obtain written confirmation from your landlord to ensure that your lease obligations have officially ended.

We are in receipt of your notice that you intend to vacate the leased premises on */*/*. Please be reminded that you agreed to rent the premises until */*/*, as specified in your Lease Agreement. Under that Agreement, you remain liable for payment of the agreed upon monthly rent, until the end of its term, whether or not you choose to reside in the premises. This also will apply to any other leases, which may remain in effect, such as a parking. Although your landlord is not accepting your surrender of the premises prior to the expiration of your Lease, in order to lessen any losses that landlord may incur by you abandoning the premises, with your permission, we will do what we deem necessary to prepare the premises for re-rental and make the effort to find a substitute occupant. Your Lease will remain in effect during the remainder of its term, unless and until the premises are re[*]rented. Absent written direction from you with regard to attempting to re-rent the premises, we will deem that you give such permission if you return your keys to the landlord. Our acceptance of those keys does not constitute an acceptance of your surrender of the premises and until the premises are re-rented, we will hold the keys, subject to your wishes. You may contact us for the keys, at any time prior to the premises being re-rented. Please be advised that even if the premises are re-rented during the remaining term of your Lease, you are responsible for any and all costs that the landlord incurs as a consequence of your abandoning the premises prior to the end of your term. As the administrative fee for re-renting the apartment is based upon a percentage of the amount of rent, the cost of re-renting the premises you have leased from the landlord has been pre-determined to be equal to one half of a month’s rent. You will also be responsible for payment of rent, as agreed upon in your lease, until the premises are re-rented At the time you vacate the premises, be sure that you remove all items of personal property. If such items are left behind, the landlord will deem them abandoned.
If the premises have been re-rented and the new tenant has signed the lease, generally, you are no longer liable for rent after that point. However, you may still be responsible for:
- Rent up to the point of re-renting.
- Administrative fees for re-renting.
- Any costs incurred by the landlord due to your early termination.
