Wrongful Eviction Case Summary
Summary
An individual in Los Angeles is dealing with a wrongful eviction case involving invalid notices and time-barred debts. Despite settling for the exact amount in the UD, the landlord filed an ex parte claiming non-compliance based on false hearsay, which they lost. This settlement is affecting their pending harassment case, despite assurances it wouldnt. The landlords intentional delay caused the debt to increase, exceeding a law firms debt limit, resulting in more retaliation and harassment. They are seeking legal assistance to address these issues and find representation despite the increased debt.Full Conversation

Hi C'Leste! Could you provide some details about your legal issue so I can better assist you?
It's 1 year today that my landlord has
been trying to wrongfully evict me.
Hi C'Leste! Here are some general steps you can take if you believe you are being wrongfully evicted:
- Review your lease agreement to understand your rights and obligations.
- Document all interactions with your landlord.
- Contact a local tenant rights organization for advice.

I owed for Covid, that was supposed to go thru small claims court. They offered to waive the debt if I just surrendered my keys last April *. I didn't. So they served me a *-day notice on May *, *, for $30k. I waited for the UD, that didn't come until Mid- October. It was filed with a different notice that I never saw before, back dated for Sept *. & For $14k, $22k LESS than expected. They removed the time-barred debts from the May notice, proving it was Invalid all along.

This began in March *, and my trial was December *, *. I asked for a continuance, which was not granted & we were forced to try and settle. They again offered to waive the now $40k debt. But they took my offer the pay just the $14k of the new notice over 6months. The filed an ex parte after my 1st payment claiming non-compliance, based on false 3rd party hearsay that was never documented or presented in writing.

Attorneys don't want to help me now that I already settled. Even though it was just for the amount I owed, & I didn't get any kind of deal.

At trial I specifically asked if settling would effect my pending harassment case and both their lawyer and the judge told me it wouldn't. But yet it is

There's nothing in the settlement clause that would. Just when I tell lawyer that I signed a stipulation, then they don't care if help me & said I should've called them a long time ago. But nobody helped me when I called for the 9 months I was in limbo. Why was I told settling wouldnt effect that, if now lawyers don't care to help me when i clearly still need it . & Why did the judge lie?

It sounds like you've had a rough experience. In California, if a lawyer misled you about the effects of a settlement or if the judge gave incorrect advice, it may be challenging but not impossible to address.
Have you tried contacting a tenant rights organization for specific advice? They might be able to provide some guidance or help find an attorney willing to assist.

It was not a reduced amount. & That's what I'm afraid the lawyers assume when they hear I settled. But it was for the exact amount in the UD, plus the following months. They did not get a penny less. It was not a "deal". Just a stipulated payment plan.

But does that make a difference? That I did not settle for a reduced amount

It could make a difference, as settling for the exact amount rather than a reduced amount might indicate you were fulfilling your obligations without conceding to potentially unfair terms.

Hi Sara, if the plaintiff's lawyer sees your request, they may become aware that you are seeking legal assistance, which could potentially influence their approach to the case. However, consulting with a lawyer to protect your rights is important, regardless of their knowledge. Would you like more information on how to proceed?

Tobener Ravenscroft is a law firm I wanted to represent me. But they have a $10k debt limit. & At the time of the May notice, I legally owed $*-$7k, fitting under their threshold. By the time my landlord stalled in fixing the Invalid notice 6 months later, the debt ballooned into $14k. Too high for Tobener Ravenscroft, but that was a calculated debt they created due to their Intentional delay. Which is just more Retaliation & harassment & I shouldn't be denied legal counsel when I didn't owe that much

Hi Sara,
It sounds like your landlord's intentional delay has unfairly increased your debt and added to the harassment. In California, landlords are required to act in good faith and not engage in retaliatory conduct.
Would you like assistance in finding another tenant rights attorney who can represent you despite the increased debt?
Would you like me to summarize your situation accurately for potential lawyers?
