Property Rights After Death
Summary
If a parent passes away without a will, their property typically goes through probate. In Florida, intestate succession laws apply if no will is found. If a prenuptial agreement exists and the spouses name is on the property, it may complicate inheritance rights. Consulting a probate attorney is advisable, especially if you are low-income and need free or low-cost legal assistance. Consider reaching out to Florida Legal Services or Community Legal Services of Mid-Florida for support.Full Conversation

Hi Tara! How can I assist you with your legal issue today?
My mother passed away and she had several properties one of which I’ve resided at my entire life. She married and had a prenuptial agreement with her husband but through the years added his name to the home to refinance it. They bought several hundred acres and moved * hours away 15 years ago. Where her husband now lives. Do I have rights to this home as she had intended it to go to one of my sons her grandson. But got ill I’m not sure if she has a will or not. What can I do to not t loose my home.
I'm sorry for your loss, Tara. Here are a few steps you might consider:
- Check for a Will: Determine if your mother left a will. This will be crucial in understanding her wishes for the property.
- Probate Court: If there's no will, the property will go through probate. Since you are in Georgia, intestate succession laws will apply.
- Legal Consultation: Given the complexity, consulting with a probate attorney would be wise.
