Tenant Subletting Rights Ontario
Summary
In Ontario, tenants can sublet or assign their rental unit with landlord consent, which cannot be unreasonably withheld. The Residential Tenancies Act (2006) supports tenant rights in subletting and assignment. An incorrect tenancy start date may affect lease terms, but does not automatically relieve tenant responsibilities. Consult a legal advisor for personalized advice.Full Conversation
first, is there anything under the Residential Tenancies Act (*) (RTA) that allows me to sublet legally anyway and that the landlord cannot just reject the concept of subletting? Also, can my landlord just reject the proposal of assigning to a new tenant entirely? The second question is, since my landlord made a mistake in our Term of Tenancy Agreement, can I move out and not be held legally responsible, even though I have been living here since August 2nd?
Under the Residential Tenancies Act (*) in Ontario:
- Your landlord cannot unreasonably refuse your request to sublet or assign the unit if the lease allows for it.
- They must provide a valid reason if they refuse.
- The incorrect tenancy start date might affect your rights, but it's best to discuss this with your landlord first.
For moving out due to the mistake in the agreement, it may not automatically relieve you of responsibility. Consult a legal advisor or tenant rights clinic for personalized advice.
