Loan Modification Legal Violations
Summary
The case involves potential violations of the Fair Debt Collection Practices Act, Truth in Lending Act, and Constitutional Rights due to a bifurcated loan exceeding legal limits. The original lender, ComUnity Lending Inc., filed for bankruptcy without proper mortgage assignment records. An invalid loan modification by BAC, lacking proper authorization and omitting a second loan, led to foreclosure. Payments made under this modification are unrecorded, and the note may be time-barred. The case includes allegations of fraud, lack of jurisdiction, and improper foreclosure, with potential claims against multiple parties, including banks and law firms. Legal advice is recommended to address these complex issues.Full Conversation

The modification came after the illegal original contract. This case involves numerous other violations, Including debt collectors pretending to be creditors, lack of Article * standing, lack of verified assignment, lack of chain of title, lack of negotiated purchase of note, lack of jurisdiction, fraud upon the court, and highlighted by not having the promissory note or the assignment of the mortgage. I am trying to write this brief incorporating all of these factors.

The loan modification agreement between Terri A. Mayes-King and Bank of America Home Loans Servicing, (BAC), dated December *, *, was recorded in Book *, Page *.
The courts ignored the invalid, deceptive modification of this loan which: (See pp. *-*)
- Added $*,*.* to the original principal amount financed.
- Did not utilize a new appraisal based on * housing depression modification standards.
- Did not include the simultaneous second mortgage.
These factors led to an illegal foreclosure As the debt collector refuses to address any of these core issue violations claiming that they were decided in The litigation which never occurred. Also have been denied due process in as much as I have never had a jury trial

Not only do I have state court violations but also in the bankruptcy court they never even submitted a proof of claim, Nor do they address fraudulently altered documents. My opponents are the Bank of New York Mellon, servicing portfolio servicing, Bank of America loan servicing, Law firms Nelson Mullins Riley and Scarborough, not to mention possible suits against state courts as my constitutional rights have been violated. If I'm not mistaken these violations can be taken into other states not to mention Washington DC. Although I am now considered indigent this is a $*,*,* house with Triple damages, pain and suffering, and relief claims.

There's no record of Bank of America home loans having holders rights or any authorization to implement a modification in which they were not a party. There's no record of where those payments to the so-called modification went. Furthermore they did not sign the December * * document until March 23rd *. Should the court ignore the 1st time-barred status this is adding a second time-barred status.
