Vehicle Impoundment Legalities

Summary

In Illinois, police can impound a vehicle if it poses a safety hazard or if DUI is suspected. However, if no DUI or property damage occurred, you may contest the impoundment. In this case, the vehicle was impounded after a fainting episode due to vasovagal syncope, with no property damage or DUI involvement. Consider consulting a local attorney to explore your options and potentially contest the impoundment.

I have a question about a vehicle that was impounded. Im trying to find out if it's was legal for the police to impound the vehicle or not
Hi ****! To help you better, can you tell me why the vehicle was impounded and if you received any paperwork from the police regarding the impoundment?
No paperwork was received. I borrowed a friend's car, drove to Walmart, pulled into a parking spot and put the car in park. I was waiting for someone to come out I had an episode and I fainted they call it a vasovagal syncope. Now due to a malfunction in the gear shift in the vehicle apparently sometimes the car doesn't go fully into Park. So when I fainted my foot came off of the break and I rolled backwards a few feet. There was no property damage and no other vehicle was involved. I was awakened by emt's and the police. I explained to them that it had been a few years since I had had this happen and was accused of being on under the influence of drugs and the EMTs informed me that I needed to go get checked out at the hospital to which I agreed but I said I needed to move the car because it wasn't in a parking spot all the way anymore.
****, thank you for sharing the details. It sounds like a stressful situation. In Illinois, the police can impound a vehicle if they believe it poses a safety hazard or if they suspect DUI. However, since you were not under the influence and no property was damaged, you might have grounds to contest the impoundment.
Have you spoken to your friend who owns the car to see if they received any paperwork or notification regarding the impoundment?
the cops said i couldnt move it and if I didn't go to the hospital and get medically cleared they would charge me with a DUI if I tried to move it. I asked if my friend who was in the store could move it, they said no. I inform them that was a friend of mine's car that I was borrowing and that I needed to pull it forward into a parking spot. They accused me of being under the influence and kept questioning me about if I had overdosed. I informed them that I didn't use drugs and wasnt under the influence of any drugs or alcohol. The only thing I had taken was my prescribed medication. They sid they were towing the car because it wasn't in s parking spot.
