Hi Puja! How can I assist you with your legal issue today?
Jan 5th, *: I informed my manager that I need to plan for surgery. The following * weeks - I kept my manager appraised that I'm working out my surgery dates and will share exact plan with her/apply for leave as soon as I have confirmation. Jan *: my manager informed me that there is a 'reduction in force' due to business reasons, and my name has been selected in a lottery , and my employment is being terminated. My last working day with the organization was March *. March 7th: I was diagnosed with 'generic anxiety disorder with panic attacks'. Since my insurance was valid till March *, I filed a STD claim and got approved. The lay off is probably illegal because I was planning for a surgery/medical leave. And it is also partially responsible for my mental suffering I believe. What do you think?
It sounds like your situation may involve potential legal issues related to employment law, particularly concerning wrongful termination and discrimination due to a medical condition. Here are a few points to consider:
- Family and Medical Leave Act (FMLA): You might be protected under FMLA if you were eligible, which provides leave for medical conditions.
- Americans with Disabilities Act (ADA): If your anxiety disorder qualifies as a disability, you may have protection against discrimination.
- Oregon Employment Laws: State laws may provide additional protections against wrongful termination.
