Animal control is DEMANDING I allow them access to my/the legal tenant of the room so they can check on the status, health, care, and, well being of the animals as well as the condition of the room. They said if I refuse, they’ll get a warrant because they have more than enough probable cause based off * anonymous phone call they got this weekend. And I know who made the call… and it’s a false report.
Hello ****, I understand your situation. Can you please share your location? Different jurisdictions have different laws regarding animal welfare inspections.
Glen Burnie, Maryland
Hello ****,
In Maryland, based on probable cause, Animal Control can seek a warrant to inspect premises. Here's some general information:
- Probable cause might be established from an anonymous tip.
- A false report can be contested later in court.
Remember, this is for general guidance and it's advisable to consult a local attorney.
So anyone can lie and animal control can get a warrant based off that?
Yes, theoretically, false reports can result in warrants. However, authorities usually conduct a preliminary investigation before acting on a tip. If you believe the report is false, you can challenge it in court later.
Later as in when? After they’ve searched my home?
Yes, ****. After the search, you can challenge the legitimacy of the warrant in court. You can also file a complaint against the person who made the false report. It's beneficial to consult with a local attorney.
