Summary
Under the Consumer Rights Act 2015, consumers can claim a refund for faulty products within 30 days of purchase. After this period, they may be entitled to a repair or replacement. I am representing a business. One of our products allegedly nearly caused physical harm to a customer (it should be noted, it did not actually cause her any physical harm). It is out of warranty however we have offered a replacement, yet she is insisting on a refund. We do not want to offer a refund as this is not our policy.
Hey ****, since the product did not cause actual harm and is out of warranty, here are some points to consider:
- Consumer Rights Act *: Customers are entitled to a refund for faulty goods, but this typically applies within a reasonable time frame.
- Offering a replacement can be considered a reasonable solution.
- Consider seeking legal advice if the customer persists in demanding a refund.
Is the customer taking any legal steps or threatening to do so?
Yes she is taking legal action
Hey ****! Since the customer is taking legal action, it might be beneficial to consult with a lawyer who specializes in consumer law. Would you like assistance in connecting with local lawyers who can help with your case? Also, could you share the location of your business?
