Jurisdictional Arrest Concerns

Summary

Jurisdictional issues can impact the validity of an arrest and subsequent charges. If arrested outside the proper jurisdiction, it may be grounds for dismissal. Evidence collected unlawfully can be challenged. If you accepted a plea deal under pressure, you might be able to file a motion to withdraw your guilty plea, especially if there are valid jurisdictional concerns or ineffective counsel. Consulting with a local attorney can provide guidance on addressing these issues and potentially rectifying your situation.

I have a question. I was stopped and arrested by Creek County police officers on January 24th, *. My boyfriend was driving the vehicle. We were both arrested and transported to the Creek County jail. Upon arriving at the Creek County jail the officers separated us and informed us that we were being charged with criminal charges. They then transported us to the Tulsa County Jail where we were booked around dawn and arraigned the following Monday. They kept both of our cell phones in Creek County as "evidence" and never took them to Tulsa. I found out the fast food establishment we were arrested at is, in fact, Tulsa County. Isn't this considered a jurisdictional issue and shouldn't the charges be dismissed on this technicality?
Hi ****! It sounds like a complex situation. Jurisdictional issues can indeed be grounds for dismissal in some cases. Here are some points to consider:
- Arrests should generally be made by officers within their jurisdiction.
- Evidence collected unlawfully can sometimes be challenged.

I was charged with Trafficking Crystal Meth- it was NOT mine and I never saw it. I was offered an initial plea deal by the Tulsa County D.A. of 5 years supervised D.A. probation. I accepted the offer upon urging of my public defender. I do have a somewhat extensive criminal background/history but nothing violent, no trafficking, manufacturing, or distribution charges or convictions, and no felonies in the last five (*) years. I accepted the deal because I was afraid of potentially being sent back to prison and to get out of jail. However, I was completely innocent of this charge. I pled guilty simply out of fear and to be released. Is it too late to fix it? I believe the D.A. offered me such a good deal because they knew the Creek County police were out of their jurisdiction and the charges should have been dismissed. It was a trick to get me to accept a plea and a conviction on my permanent background that I did NOT do.
