My fiancé is currently in federal prison on conspiracy to distribute * g of pure meth and * counts of possession of a firearm by a felon. He’s been in for 6 years out of a 288 month sentence. However he was never found in possession of any drugs or firearms. There was I think * witness statements that made these accusations and that’s what they went off of. Also they clearly stated his vehicle was not searched at that time due to lack of probable cause, but they did seize it to obtain a warrant. The search of the vehicle was not done until 11 days after the warrant and they didn’t obtain a new warrant. Also he was held on these charges at the state level then they dropped charges and told him he was released but the dea was there to arrest him at that time so they held him on state charges until they could get the indictment
It sounds like your fiancé's case might involve some complex legal issues, particularly regarding the search of the vehicle and the timing of the indictment. Here are some general points to consider:
- Search Warrants: Generally, a search warrant must be executed within a specific time frame. Delays or lack of a new warrant could be significant.
- Probable Cause: Probable cause is essential for searches and seizures. Lack of probable cause might impact the legality of the search.
- Witness Testimonies: Convictions can rely heavily on witness testimonies, but their credibility and consistency are crucial.
- State to Federal Charges: Transitioning from state to federal charges can involve complex jurisdictional and procedural issues.
