I got arrested for reckless driving, driving without a license, and controlled substance (meth) and went to jail. They set my bond at * no *%. So I was given the opportunity to get out on pre trial release my wife signed on. I was supposed to go to IOP for my condition release which since I live in Hamilton county oh. Instead of doing IOP at that place my lawyer mentioned in court I would be transferring my IOP to the county I live in. And the court agreed to that and said I just needed to hurry up and get started with IOP. My attorney said when I got started with IOP just send him my paperwork and he would let the courts know and so I did that and sent my attorney the paperwork which he completely ignored and didn't email me back about it. So I was informed December 4th when I woke up my wife had an email from my attorney asking if I was coming in today she asked why and he said I had court which I was never informed that I even had court even after me and my wife asked weeks ago when my next court date was and he again ignored me. When I first got locked up they wrote down the address on my ID and I told them it was wrong and tried to give them my new address and my wife even emailed that to my attorney and he ignored that. Well when I talked to my attorney after he called me he said that the court had already violated me anyway even before today because it looked like I wasn't attending my IOP classes because there was no communication between the courts and my lawyer. My attorney said he was gonna get me a new court date. He also said he knew it wasn't my fault but when I went to court there's a chance I might get arrested because of the violation because they didn't communicate with each other. My attorney said if I get one more clean drug test and bring proof of employment i might not go to jail but he's not *% sure. How am I getting punished for them not communicating with each other! I have proof I sent my attorney everything I needed to do.
Hi ****! It seems like you are in a difficult situation. Here’s what you can do:
- Ensure you have all your documents related to the IOP and communication with your attorney.
- Gather proof of your clean drug tests and employment.
- Discuss the communication failures with your attorney and make sure they present all evidence to the court.
Have you considered seeking a second opinion from another attorney?
