I’m going to try to keep this short. This happened in North Carolina. My sister and I borrowed her boyfriend’s car to go to Tennessee to pick up my kids. Well apparently, the place he got the car from, he hasn’t been paying the car payment or something so they reported it stolen. So of course they pulled me and my sister over and towed the truck. When they tow the truck, they searched it, and they apparently found heroin and marijuana. So they took me and my sister in. I know this is said often but it was not mine nor did I know anything about it. I’ve never stepped foot in the car until two days ago. I hired an attorney so hopefully that will help beat the constructive possession charge. Her boyfriend even called the DA and told them the weed and pipe is his and must of been laced because he only smokes pot. He stated that he had it hidden under a bunch of stuff so there’s no way we would have known it was there. What are the chances of my charge being dropped since the owner of the vehicle is owning up to the contraband?
Your chances depend on several factors:
*. Validity of search: If the police didn't have a valid reason to search the car, any evidence found may be inadmissible.
*. Proof of knowledge or control: Did you have control over or knowledge of the drugs?
*. The owner's testimony: His testimony admitting ownership may help.
Your attorney will be best equipped to assess your specific case.
