Okay so I’m being charged with assault in British Columbia Canada. Here’s what happened: I was in a bad mood and a homeless person was yelling obscenities and calling me names. I ran and pushed them. They fell face first and I dropped my wallet. They have it captured on CCTV as well as my wallet as evidence. They’re offering me a plea deal for probation if I plead guilty. I had $* in that wallet which is obviously missing now. I felt terrible and actually saw them a few weeks later and apologized but they pretended they didn’t remember. I’m debating if I should take the deal or go to trial and risk it because since they’re homeless and an addict, the chances of them showing up to trial are slim. I really don’t know what I should do
Hey ****, dealing with an assault charge is definitely stressful. In British Columbia, the decision to accept a plea deal or go to trial involves several considerations:
- Plea Deal: Accepting might result in a lesser sentence, like probation, and avoids the uncertainty of trial.
- Trial Risks: The victim's absence can impact the case, but the CCTV evidence is significant.
- Legal Advice: Consider consulting a lawyer for tailored advice.
