Hey! Feel free to share your legal issue, and I'll do my best to provide helpful information.
It is just hypothetical but if a guy hits me and I break his arm, would that be self defense
In California, self-defense can be claimed if:
- You reasonably believed you were in imminent danger of being harmed.
- You used no more force than was reasonably necessary to defend against that danger.
If you break someone's arm, the response must be proportional to the threat faced.
What would me proportional to a broken arm
In California, the concept of proportional self-defense means that the force used must match the threat. A broken arm could be considered excessive if the threat wasn't severe. Proportional force should prevent harm without causing serious injury. Always consult a legal expert for advice specific to your situation.
