Unlawful Arrest And Search

Summary

In Virginia, an arrest without a valid warrant could be unlawful, and a vehicle search generally requires probable cause. Police do not need consent for a K-9 sniff around a vehicles exterior if it doesnt extend the stops duration. An arrest warrant alone isnt probable cause for a K-9 search, but reasonable suspicion or a non-extended stop might justify it. Consulting a lawyer could help explore potential defenses or rights violations.

I was leaving a gas station and an officer saw me and said i had a warrant. I did not have a warrant because i had not been charged yet for a incident 8 months prior. i was still arrested and then warrant was issued. The file date on the actual warrant is the day after this incident took place, which proves I had no warrant at this time. While handcuffed in the police car. They police ran a k-* unit around the truck and the dog found illegal drugs. The drugs were found in a magnitized box stuck up under a work truck i was driving. Did the officers do anything wrong?
