Car Accident Legal Concerns
Summary
Charges related to a car accident can be serious, including aggravated driving to endanger, operating under the influence, and endangering a child. If the district attorney has not filed charges yet, it may indicate a delay or potential decline, but this is not guaranteed. Proactive steps like substance abuse counseling and parenting classes can be beneficial. Consulting with a local attorney in Maine is advisable to understand the legal process and potential outcomes.Full Conversation
My boyfriend, Shawn and I got into a horrible car accident on */*/*. The vehicle was totaled, I was lifeflighted and My son had a small bruise on his leg and a tiny scratch on his arm. Shawn was not arrested that day but was given * summons. Aggravated DTE, oui drugs or combo - injury, endangering the welfare of a child and reckless conduct. Shawn was accused of the oui with injury because ! was lifeflighted. I had no injury due to the accident. I have a medically documented medical condition. My hips don't face the same way as everyone else's and they pop out of place (dislocate) a lot. So when the accident happened, my hip was out of place. But my hip pops out of place when I play tennis.
I'm sorry to hear about the accident. It sounds like a serious situation. Would you like to be connected to local lawyers who can better assist you and Shawn with this case? This could be beneficial given the charges involved.
Shawn was supposed to have his court date today in Waterville, Maine We showed up at *:* this morning to find out that the DA never filed anything because they sent a request to the state troopers barracks in Houlton, Maine asking for more information and the state troopers sent them all of the requested documents, which was confirmed by a state trooper that spoke with Shawn and I today. But yet the DA still has not attempted to serve Shawn again with the new summons. Since the accident,
Shawn has started substance abuse
counseling and parenting classes on hisown free will and weekly random drug teststhat he passes every time. Does the fact that the DA still hasn't had Shawn re-served and hasn't filed anything with the court yet mean that the DA might decline the
charges?
Given the serious nature of the charges, it would be best to consult with a local lawyer who can provide guidance on the likelihood of charges being declined. Would you like assistance in connecting to local lawyers who can help with this case in Maine?
