I was dating & in a sexual relationship with a man who set me up on a controlled buy in which I am facing a level * dealing in a schedule * controlled substance with an enhancing circumstance in the presence of a minor. In an unrecorded conversation prior to police presence he set up a buy for * Vicodin from me. I had him come to the house where I was babysitting 2year old twins. I made him come into the bedroom and shut the door so the kids wouldn't see it hear anything that was happening, & that is very clear in the audio and video footage he got. He told me he had only part of the money, & that he had to get the last *$ from the truck, where there was an under cover cop waiting with it. In the affidavit the cop mentions that they had attempted multiple unsuccessful controlled buys on me in the past, although it says nothing about the man giving my phone number to the undercover cop, & him contacting me attempting to get more pills, & even offering me *$ to get them, & I say I won't do it. I didn't realize that I gave them * pills instead of *, & the man called me after and told me I gave him * extra, & I said the kids were awake and I would get the money for them later. Is there any way to defend me and win at a trial? The prosecutor is threatening to charge me as a habitual because of * prior level * possession of a controlled substance convictions prior to this. I am in Indiana.
