Felony Fleeing Defense Strategies
Summary
In Georgia, a felony fleeing charge can be serious. If no marijuana was found and the search was conducted post-crash, there may be potential defenses. The officers claim of smelling marijuana is subjective and can be challenged. Refusing a search is within your rights unless probable cause is established. The officer allowing you to handle your dog may indicate a lack of immediate threat perception. Consider consulting a local attorney to explore these aspects and develop a strong defense strategy.Full Conversation

Hey ****! Here are some points to consider regarding the officer's reasoning and actions:
- Probable Cause: The officer claimed to smell marijuana, which can be subjective and difficult to prove.
- Search Consent: You refused the search, which is within your rights unless the officer has probable cause.
- Dog Handling: You were allowed to put the dog back in the car, which could imply the situation wasn't considered fully secure by the officer.
