Hi Maurice, nice to meet you! Could you please tell me a bit about your legal issue?
Okay I was pulled over 2 years ago back in March for a traffic ticket and that was drugs found in the car *.* less than a ram but I didn't put it there the woman who I went to go see put it there and the cop he he was already saying it was drugs in the car before he even made it to the car so that's what let me know they planted it
Maurice, this sounds like a complex situation. Here are some general considerations:
- Fourth Amendment Rights: Unlawful search and seizure concerns.
- Chain of Custody: Proving the drugs were planted.
- Witness Testimony: The woman's testimony could be crucial.
Where did this incident occur? This helps identify the specific laws and procedures relevant to your case.
Leon valley San Antonio Texas
Maurice, considering your situation, you might want to focus on the following:
- Fourth Amendment Rights: Challenge the legality of the search if it was conducted without probable cause.
- Chain of Custody: Gather evidence to prove the drugs were planted.
- Witness Testimony: Contact the woman involved to testify, if possible.
Consulting a criminal defense attorney in Texas would be beneficial. Would you like help finding one?
Okay but I went to court for this because they locked me up for a warrant they came to the house issued a warrant I never went to jail on the night a question they told the car well anyway the lawyer came to meet me at the courthouse and he showed me a video of the other of the lady being arrested before I was arrested and then he showed me a video of me but he act as if he didn't know you know he didn't know what was going on and he didn't know we was cooked connected but both videos was inside of his computer so he had to know after he finished talking to me and recuse himself he wouldn't speak to me he went and talked to the prosecutor for * minutes and then he went and talked to the judge and recuse himself
Maurice, it sounds like your lawyer recusing himself may have to do with a conflict of interest, especially if he had relevant information or connections to the case. Here are some steps you might consider:
- Conflict of Interest: Investigate why your lawyer recused himself.
- New Representation: Seek a new defense attorney.
- Video Evidence: Ensure the videos are reviewed in your defense.
Would you like assistance finding a new defense attorney in San Antonio, Texas?
No I already have another public defender and I have reason to believe that they set this up because he went and talked to the prosecutor for * minutes after he talked to me and I don't think that if he if he can't talk to me he should be able to talk to the prosecutor he asked me critical questions and I feel that he told that to the prosecutor
It sounds like you have concerns about your representation and the integrity of the process. It's important to ensure your rights are protected. You may consider:
- Filing a complaint with the Texas State Bar regarding your public defender's actions.
- Requesting a different public defender if you believe there's a conflict of interest.
Is there any specific part of the process you need help with?
Yes I would like to know if it's legal for the lawyer to go and talk to the prosecutor before we after recusing himself for me and before he go to the judge about recusal I I think that he shouldn't do that and I feel like I'm not getting a fair shake
