Retaliatory Charges And Misconduct
Summary
In Nevada, if facing retaliatory charges and judicial misconduct, consider filing a motion for reconsideration or appeal, citing judicial bias. For retaliatory charges, gather evidence and consult a criminal defense attorney. If judicial misconduct is found, cases are not automatically reheard; file a motion to vacate the judgment. For prosecutorial misconduct, file a complaint with the Nevada Victims of Crime Program. Contact the Nevada Commission on Judicial Discipline for judicial issues and the Nevada Attorney Generals Office for prosecutorial and law enforcement misconduct. Prepare evidence, including documentation and witness statements, to support your claims.Full Conversation
Located in Nevada, and there are several aspects to this legal issue which involves my brother
Hi ****! Could you provide more details about the specific legal aspects involving your brother? This will help me give you the most relevant information.
He is facing false retaliatory charges in one aspect where the judge recused herself. On the other aspect he is a victim where the same judge remained on the case. The case is pending a status check, but the judgement was already made. We filed a complaint to the commission on judicial discipline, which is currently under investigation. How do we go about getting the case where he’s a victim reconsidered and how do we get someone to look into the retaliatory charges
Hi ****! To address your brother's situation:
- For reconsideration of the case where he's a victim, file a motion for reconsideration or an appeal, citing judicial bias or errors made.
- For the retaliatory charges, consult with a criminal defense attorney to gather evidence and build a strong defense.

He is under self representation
Since your brother is representing himself, here are some steps he can take regarding both issues:
- Motion for Reconsideration: He should file a motion for reconsideration with the court clerk, clearly explaining the judicial bias and citing specific examples or errors made by the judge.
- Retaliatory Charges: Collect evidence supporting his claim of retaliation and prepare a detailed defense. He may also consider seeking advice from a criminal defense attorney, even if he continues to represent himself.

A complaint was also filed with the peace officer review board. In which they were asked to find if any collusion or bias has been made. How will this affect the criminal cases
If the peace officer review board finds collusion or bias, it could strengthen your brother's defense and provide grounds for motions to dismiss or challenge the charges. Additionally, these findings could support claims of judicial misconduct in the motion to vacate the judgment.

Retaliatory criminal charges were filed after having made several complaints about a county official, Jim Basinger, who was working in his public capacity several times taking extreme actions toward my brother, a citizen. Jim basing had made threats toward my brother on at least three separate occasions. After turning in a complaint to the town of Gabbs public utilities office clerk concerning an employee who has been harassing and threatening while working in his official capacity, this complaint was ignored and a restraining order against my brother was then served upon my brother by the clerk rather than handing over his complaint. Later, Nye county sheriffs office harry means takes another verbal complaint from my brother, and he’s told that his complaint wasn’t going to go anywhere. Few weeks pass and Jim Basinger yet again threatens my brother while running toward him. My brother stands his ground and places his arm out to defend himself against the attack. Jim falls to the ground. Rather than charging the county official with crimes, they instead charge my brother with abuse of an elder. Then, a Nye county deputy shoves my brother, who wasn’t under arrest, and while my brother didn’t see who pushed him, he turned around and pushed back, saying don’t push me. Then is placed under arrest for batter upon a peace officer.

Dear Attorney General,
I am writing to file a formal complaint regarding judicial, prosecutorial, and law enforcement misconduct in the case involving [Case Number/Details]. This complaint involves several critical aspects:
- Retaliatory Criminal Charges: Multiple complaints were made about County Official Jim Basinger, who threatened my brother on several occasions. These complaints were ignored, and instead, my brother was served with a restraining order by Nye County, where Nye County was listed as the applicant. Subsequently, my brother was charged with abuse of an elder after defending himself against an attack by Basinger.
- Denial of Victims' Rights: The prosecutor failed to inform the victims of any court hearings and only contacted them after a plea agreement had beenmade.
- Harassment Complaint Ignored: My brother's complaint to the Town of Gabbs Public Utilities Office about Jim Basinger's harassment was ignored, leading to retaliatory charges and further threats from Basinger.
Details of Incident:
- Judicial Misconduct: [Describe instances of judicial misconduct, such as bias or errors made.]
- Prosecutorial Misconduct: The prosecutor failed to notify the victims of court hearings and only contacted them after a plea agreement was made.
- Law Enforcement Misconduct: Nye County Sheriff's Office ignored my brother's harassment complaints and charged him with abuse of an elder instead of investigating Basinger's threats.
These actions have severely impacted the fairness and integrity of the legal process.
Details of Incident:
- [Date and Incident Details]
- [Specific examples and evidence]
- [Attach supporting documents]
I request a thorough investigation and appropriate action to address these serious issues.
Sincerely,
