License Suspension And Paraphernalia

Summary

Driving on a suspended license in Georgia can be contested if you had a valid out-of-state license and the suspension was due to an old ticket. Possession of drug paraphernalia, even without meth, can still lead to charges. If the search of your vehicle lacked probable cause, it might be challenged in court. Additionally, you may have grounds for a civil suit if the incident led to job loss and financial burdens. Consider consulting a local attorney to explore your legal options and potential defenses.

Hi ****! In Georgia, the legality of a search often depends on whether the officer had probable cause or if the search was conducted incident to an arrest. If you believe the search was illegal, it could be a significant defense point. Consider these aspects:
- If the search was conducted without consent or probable cause, it could be challenged.
- Evidence obtained from an illegal search might be inadmissible in court.
Would you like more detailed information on challenging the search or any other specific aspects of your case?
Yes

Hi ****! Here are some potential points for challenging the search:
- Probable Cause: If the officer didn't have a valid reason to search your car (e.g., no probable cause), the search could be deemed illegal.
- Incident to Arrest: Searches incident to a lawful arrest are typically allowed, but if your arrest was questionable, this could be contested.
Is there anything specific you would like more detailed information about regarding challenging your search?
The officer ran my license he said twice I had a Alabama license because at that time I was still a resident in Alabama and he said my license came back clean so he ran it again for Georgia and than he said they were suspended but how can you have valid license in one state and not the other

Hi ****! This situation can be complex due to the differences in state laws regarding driver's licenses. Here’s some general information that might help:
- Driver's License Validity: It's possible to have a valid license in one state and a suspended one in another due to state-specific regulations or violations.
- Interstate Compact: States share information on license status; an issue in one state can sometimes affect your status in another.
Would you like more information on navigating this situation or any other specific aspects of your case?
Here is the kicker lol the reason Georgia suspended my license is for a traffic ticket I had that was 10 years old

****, it sounds like you have several aspects to consider:
- Driving on a Suspended License: The age of the ticket and proving you had a valid out-of-state license could be significant.
- Drug Paraphernalia Charge: Challenging the legality of the search might be a key defense.
Would you like more details on either of these points or any other specifics about your case?
