My lawyer went to the hearing to allow our motion to file answer and counterclaims in our eviction case and the judge, who is not the judge assigned, had my husbands criminal case file and asked my lawyer if he knew my husband was involved in a criminal case. I was in Cleveland clinic getting diagnosed with fibromyalgia and a lot of my labs are coming back for multiple myeloma
In Virginia, judges are generally supposed to review files only for cases they are directly presiding over. It seems unusual for a different judge to access your husband's criminal case file during an eviction hearing.
