Hi Angie! What specific legal issue are you facing in Indiana? This will help me provide the most relevant information.
I worked with a lawyer that violated several codes of professional conduct. I have submitted a complaint to the disciplinary commission. That lawyer refused to share with me an invoice for 3 months, and recently submitted on to me that has some inaccuracies and discrepancies, for example showing calls lasting for multiple hours when they were only minutes, or showing on the invoice that he had reviewed submitted documents though in a call states he has not reviewed. He also charged a significant amount for trial prep, though he chose to file a continuance the day before the hearing. He frequently failed to keep scheduled appointments, and nearly all of our communication was over scheduling and rescheduling on his part.
That sounds very frustrating, Angie. Given the circumstances, it's good that you have submitted a complaint to the Disciplinary Commission. They will investigate the matter thoroughly.
Have you considered seeking a second opinion or consultation with another attorney to go over the invoice and potentially support your complaint with more evidence?
I am wanting to pursue him for malpractice, but am willing to settle for him paying me back my full retainer. He does not conduct himself with integrity or honesty. Should I let him know what parts of the bill I am contesting and why along with letting him know that I will pursue legal assistance if we can not resolve it ourselves? Or should I just get a lawyer?
Hi Angie! Here's a general approach:
- Detail the contested parts: Clearly outline the parts of the bill you are contesting and provide reasons.
- Communicate your intent: Inform him that you will seek legal assistance if the issue isn't resolved.
- Consult a lawyer: It's often beneficial to get professional advice to ensure your rights are protected.
