I got hurt at work and work denied me due to. They said it was pre-existing. The doctor scheduled me for MRI possible surgery and he put me on light duty sit down work only until work clears me but when they denied me, I was wearing a knee brace and could barely even walk let alone they wanted me to go back to work full duty for eight hours standing when I clearly just seen the doctor two days ago before they denied me, Workmen’s Comp. then I got a call from my employer stating that if I didn’t go to work, then I was gonna I was gonna point out and get terminated. I went to surgery two days ago and even the doctors note said that it was more related, but the doctor never wrote off about anything about me going back full duty.
Workers’ compensation claims can be challenging, especially when they involve disputes over pre-existing conditions. Here are some steps you can take:
- Contact a workers’ compensation attorney immediately. They can help you appeal the denial.
- Gather all medical records, including the doctor’s note tying your injury to work.
- Document all communication with your employer, including threats of termination.
- File an appeal with the Missouri Division of Workers’ Compensation if you haven’t already.

My name is Ryan floore I have a lawyer for my work comp. My lawyer is the one that told me to reach out for Wrongful Termination,.
If your workers’ compensation lawyer suggested reaching out for a wrongful termination claim, it may be because your employer's actions (like threatening to terminate you for not returning to full duty against medical advice) could violate Missouri employment laws.
Missouri is an at-will employment state, but employers cannot terminate someone for reasons like retaliation (e.g., for filing a workers’ compensation claim).
